The Board has noted the Minister’s instruction purporting to terminate the membership of the remaining Board members and to impose transitional governance arrangements over the Ingonyama Trust.

The Board is of the considered view that the Minister’s instruction is unreasonable, unlawful and inconsistent with the KwaZulu-Natal Ingonyama Trust Act and the applicable Administrative Regulations. The Board therefore cannot comply with an instruction it regards as illegal.

The Board has sought legal advice on the matter and is taking the appropriate steps to protect the integrity of the institution and ensure compliance with the law. Pending the outcome of that process, the Board will continue with its operations in fulfilment of its statutory responsibilities.

The Board remains committed to lawful governance, due process and the protection of the interests of communities residing on Ingonyama Trust land.
